Property in Australia has enjoyed significant capital gains in the last decades.  Unfortunately, these value uplifts can result in some complicated and often unexpected holding costs. This is especially the case with land tax. Land tax can expose landowners to significant cash outlays on unrealised land values.

How Land Tax Works in NSW

Land tax in NSW is imposed on landowners based on the value of all taxable land above a certain threshold. Limited exemptions are available, including the principal place of residence exemption.

Current Rates and Surcharges

The 2025 rate of land tax in NSW is $100 plus 1.6% of the land value above $1,075,000. This is a significant impost. Premium duty can also be payable for land valued above $6,571,000.   Foreign landowners may also face a surcharge which further adds to the cost.  

Registration and Risk of Unexpected Assessments

While landowners are required to register for land tax, an unexpected assessment or failure to apply an applicable exemption can result in hefty payments.

Your Right to Object

If you have received an unexpected assessment of land tax, you have the right to object to that assessment within a specified timeframe.  An adviser can also provide advice on the best way to object to valuations of the land held by a taxpayer.  Separate timeframes and processes apply in each case.
